Properties Magazine recently featured Frantz Ward Associate Andrew M. Hanna for his “Legal Perspectives” article, “Balancing Preservation with Modern Code Compliance: Legal Risks in Renovation & Restoration.”

In the October article, Drew outlines the legal challenges that arise when adapting historic buildings for modern use. He highlights the need to meet current compliance standards and proactively address compliance-related responsibilities during contract negotiations.

Modern Standards Applied to Historic Structures

Drew explains that once renovation begins, current building codes often apply in full. Many owners mistakenly believe older buildings are “grandfathered in” under outdated codes and are surprised to be flagged for common compliance “hot spots,” such as:

  • Accessibility: ADA-compliant entrances, bathrooms, and parking
  • Fire & Life Safety: Sprinkler and alarm installations in older materials
  • Energy Codes: Window and HVAC upgrades that meet conservation standards
  • Structural Safety: Reinforcing framing and load-bearing systems to current code

Proactive Contracting Is Key
He emphasizes that the best protection against disputes is careful contract planning and recommends:

  • Adding clear compliance clauses that assign responsibility for upgrades.
  • Establishing detailed change-order procedures to manage costs.
  • Conducting preconstruction investigations to uncover likely compliance needs.
  • Considering shared-risk or insurance strategies for historic projects.

As Drew notes, successful renovations and restorations depend on clarity and communication. By addressing code requirements early and defining responsibilities upfront, property owners and contractors can protect their investments while preserving architectural heritage.
