The Trump Administration’s Position on Marijuana

We looked. We couldn’t find one.

Marijuana is illegal under federal law. That has not prevented the creation of a $6 billion industry. For the last eight years, the U.S. Department of Justice has not enforced federal law where a State has “enacted law legalizing marijuana in some form” with “strong and effective regulatory and enforcement systems.” Will that change? The Trump Administration is sending mixed messages.

On the campaign trail, Trump stated that marijuana legalization should be left “up to the states.”

However, Attorney General Jeff Sessions has made comments critical of marijuana during his time as the Senator of Alabama, and even recently suggested that marijuana is fueling a rise in violent crime.

Press Secretary Sean Spicer may have tried to clarify the situation by first stating, “I do believe that you’ll see greater enforcement” of recreational marijuana use, and then adding, “There’s a big difference between the medical use … [and] recreational use, which is something the Department of Justice will be further looking into.”

The Department of Justice is presently preoccupied with wiretaps, elections and Russia. During this time, it is likely the marijuana industry will continue to grow.
