Mark L. Rodio Discusses Residential Disclosure Updates for the Ohio State Bar Association

Partner Mark L. Rodio examined recent changes to Ohio’s residential property disclosure requirements on the Ohio State Bar Association’s (OSBA) Advanced Residential Real Estate Updates webcast, a half-day continuing legal education program held September 16, 2026.

In his presentation, “Update on Residential Disclosures, Including Ohio Supreme Court Case Concerning Disclosure of Utilities,” Mark covered the Seller Fair Housing Disclosure Form and the Wholesaler Disclosure Law, both of which took effect this year.

He also discussed the Ohio Supreme Court’s decision in Ashmus v. Coughlin, in which Mark obtained a unanimous decision in favor of the seller. While the Court recognized that Ohio’s disclosure law expanded a seller’s duty to cover known patent defects as well as latent ones, it held that a sewer located within a publicly recorded sewer easement is not a material defect that must be disclosed.
