John F. Kostelnik and Naomi G. Tellez Discuss Chapter 11 Executory Contracts at Great Lakes Regional Bankruptcy Institute

Frantz Ward Partner John F. Kostelnik and Associate Naomi G. Tellez presented “Assume at Your Own Risk: A Look at Executory Contracts for Suppliers” during a CLE event held by The Pat E. Morgenstern-Clarren and William J. O’Neill Great Lakes Regional Bankruptcy Institute of the Cleveland Metropolitan Bar Association. The event took place at the Cleveland Metropolitan Conference Center on Thursday, December 4.

In their commercial breakout session, John and Naomi discussed the definition and obligations of an executory contract, comprehensive tips for managing Chapter 11, and key insights on contract assumption and objection.

John represents creditors in complex bankruptcy and workout situations. He has extensive experience as first chair in numerous successful Chapter 11 cases and is well-versed in all aspects of workouts, lender liability, creditors’ rights, and bankruptcy law.

Naomi focuses her practice on business transactions and commercial law and plays a key role in representing clients in commercial transactions. She negotiates a wide range of commercial contracts and brings significant second-chair experience representing major creditors in connection with complex Chapter 11 issues arising during high-profile insolvency proceedings.
