Overview

As a member of the Construction Practice Group, Alan prides himself on being an experienced and trusted advisor for construction industry professionals and typically consults on construction projects from cradle to grave. Alan’s practice consists of representing owners, contractors, design professionals, construction managers, suppliers, and surety companies in negotiation of construction contracts with the intent to advise of and limit potential claims and liability; in claim documentation and preservation throughout the project; and in the complex civil and commercial litigation and alternative dispute resolution of all types of construction disputes-typically involving claims and defenses associated with breach of contract, breach of warranty, design, defect, delay, prompt pay, payment and performance surety bonds, mechanic’s liens, attested accounts, and negligence-which generally commence at or after the project’s conclusion.

Practices

    • Negotiated favorable settlement on behalf of demolition subcontractor of a scope dispute with the construction manager arising from construction of new facilities for a Northeast Ohio university.
    • Successfully preserved contractor’s award of summary judgment against subcontractor on appeal to the Court of Appeals of Ohio, Eighth Appellate District.
    • Served as trial counsel in successfully obtaining judgment on all counts for concrete supplier in lawsuit in which concrete supplier was both asserting claims against and defending claims by the cement subcontractor and prime contractor on a multi-million dollar school project.
    • Negotiated favorable settlement on behalf of excavating subcontractor through mediation with general contractor of dispute arising from multi-million dollar construction of automobile dealership.
    • Obtained summary judgment on client’s behalf in lien priority dispute resulting in windfall settlement with title insurance company in client’s favor.
    • Negotiated favorable settlement on behalf of paving subcontractor with prime contractor and owner of multi-party and multi-claim dispute arising from construction of grocery store.
    • Negotiated favorable settlement on behalf of heavy highway prime contractor of dispute with subcontractor arising from the subcontractor’s termination for cause on the project.
    • Represented both lenders and borrowers through every stage of the process involved with loan workouts, including without limitation, collection, commercial and residential foreclosure, receivership, and bankruptcy.
    • Represented businesses in resolving all types of disputes that arise with their vendors or customers, or among the business owners individually.
